Terms of Service

1. Who these terms apply to

These terms are an agreement between Amazing Photo Video Inc. (“APV”, “we”, “us”), a Toronto, Ontario company, and anyone who books our services or uses www.amazingphotovideo.com and its subdomains. By placing a booking or using the site, you accept these terms. If you book on behalf of a team or brokerage, you confirm you are authorized to bind it.

2. Services & bookings

We provide real estate photography, videography, 3D virtual tours, drone imaging, virtual staging, floor plans, headshots and related media services across Toronto and the Greater Toronto Area. Bookings are made through our website, booking platform, phone or email, and are confirmed when we accept the appointment. Published prices (see pricing) are in Canadian dollars, plus HST, and are based on the property’s square footage as listed or provided; if the actual size differs materially, the applicable tier applies.

3. Client responsibilities

• Ensure we have lawful access to the property at the appointment time, and that the property owner consents to the shoot and to the marketing use of the media.
• Have the property shoot-ready. Our team photographs the property as presented; staging, tidying and decluttering are the client’s responsibility unless a staging service is booked.
• Secure pets and inform occupants that photography/video will take place.

4. Payment, cancellations & weather

• Payment is due on or before delivery unless your team has approved account terms. Deliverables may be withheld until payment is received.
• Cancellations or reschedules with less than 24 hours’ notice, or inability to access the property at the appointment time, may incur a fee of up to 50% of the booked services.
• Exterior, twilight and drone work is weather-dependent. If conditions prevent safe or quality capture, we will complete what is possible and return for the remainder at no extra charge, or reschedule.

5. Drone operations

Aerial work is performed by Transport Canada certified pilots in accordance with Canadian Aviation Regulations. Airspace restrictions, weather or safety considerations may limit or prevent drone capture at some locations; where aerial work cannot be completed lawfully and safely, we will advise alternatives or adjust the order.

6. Delivery & revisions

Standard delivery is 24–48 hours from the shoot for most services. Media is delivered through our delivery platform. We include reasonable revisions consistent with our editing style (for example, corrections to processing errors); additional editing beyond the ordered scope may be quoted separately.

7. Media ownership & license

All media we create is the intellectual property of Amazing Photo Video Inc. When you commission a shoot, you receive a non-exclusive, royalty-free license to use the delivered media to market the specific property it was created for — including MLS/TRREB, REALTOR.ca, your own website and social channels, and print marketing for that listing. The media may not be materially altered, resold or sub-licensed to third parties, and may not be used for unrelated properties or projects. 8. Liability

We carry professional liability insurance and take care on every shoot. To the extent permitted by law, our total liability for any claim relating to a shoot or the services is limited to the amount paid for the services giving rise to the claim, and we are not liable for indirect or consequential losses (including lost commissions or delayed listings). Nothing in these terms limits liability that cannot be limited under applicable law.

9. Website use

The content of this website — text, imagery, video, tours and design — belongs to APV or its licensors and may not be scraped, republished or used to train commercial datasets without permission. You agree not to misuse the site, attempt unauthorized access, or interfere with its operation. Our handling of personal information is described in the Privacy Policy.

10. General

These terms are governed by the laws of Ontario and the federal laws of Canada, and the courts of Ontario have exclusive jurisdiction. If any part of these terms is found unenforceable, the rest remains in effect. We may update these terms from time to time; the effective date above reflects the current version. A separate written agreement between APV and a client prevails over these terms where they conflict.
